Terms and conditions

 

§ 1 General Provisions

1This terms and conditions lay down rules for the sale of goods presented in the online shop and the provision of electronic services by Regess Sp. z o.o. with registered office in Jelenia Góra  (58-500), Bankowa 36 St, entered in the register of entrepreneurs of the National Court Register kept by the District Court for the City of Wrocław – Fabryczna in Wrocław, 9th Commercial Division of the National Court Register, under KRS number 0000280241, NIP number 6112622738, REGON number 020529831.

 

2. The notions used in the Conditions mean as following:

a) The working day - day of the week from Monday to Friday excluding public holidays in Poland,

b) Client – a private person, legal person or organizational unit which does not have legal entity, but is given legal, capcity by certain regulations and makes an order in the Internet Store,

c) Account - assigned to each user personalized part of an Internet store, which stores user’s personal data,

d) Shopping cart - information on goods selected by the Client which are to be Object of the agreement,

e) Internet Store (Shop) – internet website at www.polandi.eu address, via which the Client may place Orders,

f) Seller - an entity referred to a § 1. 1 of these Terms and Conditions,

g) Recipient - an entity using the Seller services,

h) User - an entity with an account in the Internet Store.


3. Seller communicates with the Client in a way accessible to the Client by giving priority to electronic communication, unless the Client described other method of contact. 

 

§ 2 Services provided via electronic way


1. Range of electronically supplied services include:

a) maintaining of the Shop account, 

b) storing of the shopping cart data at the Shop during the open session (browsing the Internet store), 

c) sending order information via e-mail, 

d) presenting of goods and services, 

e) receiving complaints and withdrawal statements. 


2. The use of electronic supplied services requires an active e-mail account and a PC, Mac, or similar computer connected to the Internet and equipped-tainable in the operating system, web browser-enabled Java Script and "cookies", the mail electronic and software to operate a PDF files.


3Using the services referred to in paragraph 1 point a and c requires authorization or authentication. Authorization is done via e-mail. Authentication consists in confirming the Client's identity using established during the ordering data service access.

 

4. The service is provided from the moment of conlusion of the agreement. Recipient agrees to supply of digital content which causes a loss of the right of withdrawal for services supplied electronically.


5.Creating an account takes place with the registration of the Client. Register at the Internet store is voluntary and not subject to charges.

 

6. User is obliged to keep access data in secret, especially the account password established during registration. In the event of data loss or adoption by others of their content, you must immediately notify the Seller.


7.The Client is obliged during the period of service:

a) respect for law and the provisions of these terms and conditions, 

b) use the seller service as intended, 

c) no use of hardware, software and any other methods that could disrupt the Shop, 

d) do not deliver content that is unlawful, 

e) notify the Seller  of data changes that may affect the implementation of the agreement.


8.The User may terminate the provision of the service at any time.


§ 3 Sale of goods


1. The information in the Internet store does not constitute an offer, but only an invitation to contract. We are offering the order placed by the Client.


2.Within 14 days of the conclusion of the agreement, the Client is required to pay for the goods ordered together with the cost of delivery, unless specified payment on delivery. It is understood that failure to pay within a client's statement of withdrawal from the agreement.

 


3.Payment may take place:

a) by transfer or payment to the seller's bank account 

b) by e-transfer through the eCard system:

-ePrzelewy: Pay with Inteligo, mTransfer, MultiTransfer, Przelew24, Pay with BPH, Pay with Inteligo, Pekao24Przelew, Pay with Citi Handlowy, PayWay Toyota Bank, Meritum Bank Transfer, Pay with BOS, Pay with Alior Bank, Millennium - Internet payments.

4.The Seller shall accede to the order completion on receipt of payment.


5.If the goods in order has different completing time, all order will be shipped in the time of longest good completing.


6. The Seller shall deliver the goods brand new and free from defects.

 

7.In case of damage during transportation package the Client has right to require the courier to write down the appropriate protocol.

 

8.The Seller shall not be liable under the warranty if the product was acquired by the entrepreneur for purposes directly related to his business activities.


9.Goods presented in the Shop may be covered under warranty. For more information see the description of the product.


10.The Client agrees to receive invoices electronically. Consent may be withdrawn at any time.

 

 

§ 4 Withdraw from the agreement 


1.The Client has the right to withdraw from the agreement without giving any reason until the Seller starts realisation of the order.


2.The Client who is a consumer has the right to cancel the agreement within 14 days of the entry in possession of the goods without giving a reason. If the last day of the period for withdrawal falls on a Saturday, the deadline is extended to the next working day. To preserve term it is enough to send a statement before its expiry.

4.In case of withdrawal the Client bears the returning cost and the additional costs resulting from the type of delivery other than the least expensive in usual way of delivery.


5.The Seller returns a payment immediately after receipt of the notice of withdrawal, but not later than within 14 days. Reimbursement payments shall be using the same methods that were used in the original transaction, unless otherwise specified.

 

 

§ 5 Complaint

1.The Client has a right submit a complaint in any form supported by the Seller.


2.The complaint should contain the identity of the Client, the subject of complaint and its justification. Consideration of the complaint within 14 days from the date of receipt, which the Client is notified in the form indicated in the text of the complaint, and if it has not been determined - in the form in which it was made.


3.Complained goods should be delivered to the following address: Regess Sp. z o.o, Bankowa street 36, 58-500 Jelenia Góra, province Dolny Śląsk, Poland with postscript Polandi.eu


§ 6 Processing of personal data

1.The Seller is the administrator of personal data under the relevant laws.


2.The Client consents to the processing of personal data in accordance with applicable laws in scope and purpose necessary to perform the agreement.


3.The Client has the right of access to their personal data, correct them and demand removing them by Seller.

 

4.Providing of personal data is voluntary, except that the conclusion and execution of the agreement it is necessary to provide the data defined at the conclusion of the agreement.


5.The range of the data processed by the Seller’s clients base includes:

a) name, address (street and house number / flat, zip code, city and country), telephone number, email address, TIN (tax identification number),

b) operating data concerning the use of electronically supplied services.


6.The Seller does not provide and does not provide clients' personal information with third parties unless it is necessary to carry out the agreement with the Client. The Seller may transfer users personal information in particular courier and operator of transfer payments company.


7.The Seller provides protection against unauthorized access or use of processed personal data.


§ 7 Cookies

1.When you do shoppping online, are collected automatically information about the recipient in the "Cookies" which are stored in the device of the recipient.


2.Cookies are used for the following purposes:

 a) adapt the content of Internet store to the individual preferences of the recipient,

 b) ensure security while browsing the Internet store,

 c) optimizing the functioning of the Internet store,

 d) statistics.


3. The use of Cookies determines the recipient by the settings in your application to browse the content contained on the Internet (Web browser).

 


4.Restricting the use of "Cookies" can affect the functioning of the Internet store to a given recipient.


§ 8 Final provisions

Any dispute of this agreement may be settled in the course of the mediation or the court of arbitration. Procedures defines the entity established by the parties to resolve the dispute.
